1. Acceptance of Terms
By accessing or using Goava ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.
2. Eligibility
You must be at least 13 years old to use Goava. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using Goava, you represent and warrant that you meet these eligibility requirements.
3. Account Registration
To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. User Conduct
You agree to use Goava in compliance with all applicable laws and our Community Guidelines. You will not: • Use the App for any illegal or unauthorized purpose • Harass, abuse, or harm other users • Post content that is defamatory, obscene, or violates others' rights • Attempt to gain unauthorized access to the App or other users' accounts • Use automated means to access or interact with the App • Interfere with the proper functioning of the App
5. User Content
You retain ownership of content you post on Goava ("User Content"). By posting User Content, you grant Goava a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with the App. You represent that you have all necessary rights to grant this license.
6. Events and Interactions
Goava facilitates connections between users and provides information about events. We are not responsible for the conduct of any user or the outcome of any event, whether online or offline. You acknowledge that interactions with other users and attendance at events are at your own risk.
7. Payments and Tickets
For paid events, payments are processed through our secure payment partners. Refund policies for tickets are set by event organizers. Goava may charge service fees for ticketed events. All fees are non-refundable unless otherwise stated or required by law.
8. Intellectual Property
The App and its original content, features, and functionality are owned by Goava and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written consent.
9. Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms or our Community Guidelines. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings.
10. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL LIABILITY FOR ANY HARM ARISING FROM YOUR USE OF THE APP OR INTERACTIONS WITH OTHER USERS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOAVA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.
12. Indemnification
You agree to indemnify and hold harmless Goava, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the App, your User Content, or your violation of these Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
